A federal jury in Knoxville, Tennessee, has ordered Dollar General to pay $277,565 to a former cashier the company fired for drinking a bottle of orange juice during a diabetic emergency. Linda K. Atkins, an insulin-dependent diabetic, worked at a Dollar General store in Maryville, Tennessee. She had told her supervisor about her condition and asked more than once to keep juice near the register in case of a hypoglycemic attack. According to the Equal Employment Opportunity Commission’s lawsuit, the cashier testified that her supervisor told her that Dollar General did not allow employees to keep food or drink near the register. One day in 2011, while alone in the store as both manager and relief cashier, Atkins felt an attack coming on. She grabbed a bottle of orange juice from the cooler and drank it rather than leave the register unattended. As soon as the episode passed, she paid for the $1.69 bottle plus tax. Weeks later, a district manager and loss prevention manager came to the store to investigate inventory shrinkage. Atkins admitted she had drunk the juice before paying for it. She was fired for violating the company’s “grazing” policy. Dollar General did have an accommodation policy that could have let Atkins keep juice at her register, but store management was apparently never trained on it. The EEOC sued in September 2014, and Atkins later joined the case herself. In September 2016, the jury sided with her, awarding $27,565 in back pay and $250,000 in compensatory damages. The panel did not find that Dollar General acted with malice. Atkins had worked for the company since 2009, rising from sales associate to lead sales associate before her firing.
