I love Pattie but she is severely in the LEGAL wrong. That’s an important distinction to make because again she is severely for years overstepped many legal boundaries. Now it’s a legal requirement for the company to step in. Again perhaps they could have found another way, but the truth is legally this is what was going to happen

they're suing because pattie filed a trademark to sell apparel. it is too close. and yes, they do have to defend their tm or they're at risk of losing it. if pattie had not filed a tm in something so similar to what they already have, it would have been a non-issue. and no, I'm not a lawyer (I'm a biologist), but I had my lawyer friends explain it to me because trademark law is confusing af.

I don't know that it's legally compelling either, there's not even really anything in violation of their trademark 😭 like it's clearly parody and inspired by the same AREA OF LAND 😭😭 this is more cut and dry than the Mattel/Aqua beef with "both parties are advised to chill"

Yes they do. If they do not they risk their most valuable asset: their brand. And guess who has donated 100s of millions to climate change activism? Hint, it’s not Pattie Gonia. So by risking their brand they risk $100 million a year plus in climate donations.

They maybe should have chosen a name that wasn't a giant region in the world. I think it's going to be tough to argue that they have a trademark on anything related to outdoors and associated with a huge region of South America. Not to mention the horrible press.

can we also talk about how this corporation's primary customer base is yuppies? the cultural demographic that is "socially liberal, fiscally conservative"? so this is very on brand and could be a "bad publicity is better than witty parody by the non-respectable gays" situation. eco-activism is also regarded as more dangerous/associated with t-rism than almost any other movement in the US. I bet they got a bunch of hate mail from Karens who voted for Harris and feel like "drag is fine just not on social media" etc etc.

This is a both sides suck situation. Pattie was out of line but shouldn’t get sued into bankruptcy. Patagonia has a right to protect their trademark but need to understand how ridiculous and evil this task is. I don’t know what the right answer is but hashing it out in the courts seems wrong

Pattie Gonia is not being sued. Her corporation is. It's called Entrepreneur Enterprises Incorporated, is a privatized multi-million-dollar company with it's own legal advisors, and is owned by Wyn Wiley who's public persona is Pattie Gonia. Patagonia Incorporated is a multi-million-dollar B corporation owned by shareholders of the non-profit organization Holdfast Collective who spends 98% of it's revenue in activism and publicizes that information and also holds publicly available audits for the other 2%.
