IP lawyer here. Patagonia is being quite rational here. TM law protects small plaintiffs against big corporations a LOT, it is one of the last avenues of law where federal courts have not completely kowtowed to corporations. if Patagonia loses this case it will hurt everyone.

Merch could still have her face all over it or her hiking in high heels, used something like 'Pattie's Hiking Club', or 'Pattie's Peaks', or 'Mile High Heels'. one thing that struck me about the lawsuit was that it was written in such plain and understandable language and didn’t have a lot of confusing legal jargon, and when i talked to my law friend she was saying that it’s pretty clear that this is a cut and dry case for patagonia and the law is on their side, so instead of trying to convince the court of their case this document serves more as an explanation of why they had to do it

this is a really well-put video. my stance too is that if you are sued and choose to come onto TikTok to give your side of events versus arguing it out in court, there’s probably some inkling that you know you’re probably not winning that lawsuit and are instead looking for approval in the court of public opinion because otherwise you’d just let it all be worked out in litigation, which is kind of frustrating tbh because that opens the door for disinformation to spread (and I’m already seeing that with this situation) 🫠

I will say Patagonia needs to teach other companies how to communicate because their emails all the way from 2022 onward are so respectful and clear. It’s very obvious they saw her as a person and that they truly respect people for being people. I’ve never seen such polite communication over potential conflict in the business world ever. Props to Patagonia
