I mean if you blow over a .15 you kinda deserve that DWI upgraded charge cause why you driving that drunk. I got a DWI in 2012 refused to blow, got that occupational license & stayed my butt at home at night. Got pre-trial diversion, did the leg work and learned my lesson

dont they factor in time it took to take the test if they have to wait. so if you blew less than a .08 after the warrant is issued they just add on the time that your body processed the alcohol and arrest you for dwi anyway
