Customer could have also done a simple Google search then.. at what point does the customer have any responsibility… people forget that we are just a middle man , we didn’t own the car from new, nor did we manufacture it . Buyers need to do their own due diligence before purchasing a car

This is the scenario in most cases. A dealer buys a car at auction, and its structural damage is announced, so the dealer is aware. The car hits the lot for sale the same day or a few days later, depending on the location purchased. The car is sold with a clean Carfax because Carfax isn't updated with the car being sold at auction with announced structural damage. This happens all the time. Most dealerships will sell the car, but the customer is aware of such damage, even though Carfax isn't showing it yet, and they have them sign, acknowledging such. But there are just as many dealers that play dumb. And if you purchased such and didn't sign saying you were aware, you have a leg to stand on by law, at least in Ohio, and I'm sure in most states. "As-is" does not mean a dealership can sell you a salvage or structurally damaged vehicle without telling you and having you sign an acknowledgment even if Carfax says clean because the dealer knows from the auction announcement.

Ev auto should take the car back and give a full refund. Then it’s EV Autos problem to get their money back from who they bought it from. Very simple fix.

While Copart is known for selling salvage title vehicles, they also sell repossessed and donated vehicles with clean titles also. Not sure why this is an issue if the title is clean.

No dealers will tell you about accidents on carfax. I learned this the hard way. It’s unfortunate but the customer has some responsibility to do some research on their purchases too.
