@brmgantidote: Lie 1: “It was dismissed without prejudice so she can’t refile” Truth: “IT IS ORDERED… those claims are remanded to the Circuit Court of Jackson County, Mississippi.” Remanded doesn’t mean dismissed. It means the case is SENT BACK to state court alive. If it was fully dismissed, there would be nothing to send back. Lie 2: “She lied about refiling, it’s over” Truth: She dismissed her federal claims WITH prejudice because she agreed to.“Plaintiff Heather Wyatt hereby files her Joint Stipulation of Dismissal with prejudice, as to ALL FEDERAL CLAIMS.” JOINT means both sides agreed. The state claims were NOT dismissed. “it can be remanded to state court without danger of plaintiff’s claims being foreclosed by state statutes of limitation.” The judge protected her right to continue. So yes, she CAN refile/continue in state court. Lie 3: “Her claims are all deficient” Truth: The only “deficiencies” mentioned were about an old Motion to Amend that was denied without prejudice, which means she CAN fix it. “Wyatt’s state-law claim appears to raise a potentially novel issue of state law as she is attempting to hold the school district responsible for her daughter’s suicide. Indeed, this Court is unaware of any similar cases in Mississippi.” A federal judge called her claim NOVEL and important. That’s not “deficient.” Bottom line: Not dismissed. Not over. Not deficient.
