@meghannmcuniff: It appears two jurors believe a woman who saw her sons killed by a speeding SUV driver deserves more than $35 million for her past and future emotional distress. One juror answered “no” twice and another once when the judge polled them today about their $176 million verdict against Rebecca Grossman and Scott Erickson. Juror 10 said no to Nancy Iskander’s $10 million in past damages and $25 million in future damages for her emotional distress over the collision that killed 11-year-old Mark Iskander and 8-year-old Jacob Iskander in a crosswalk in Westlake Village, California, on Sept. 29, 2020. Juror 8 said no to the $25 million, too. No one can speak to the jurors because they still have to decide punitive damages, so we don’t know why they said no, but they said yes to younger brother Zachary’s $34 million in damages and the other damages, which indicates they don’t believe these numbers are excessive. Before they decided the emotional damages, jurors had to agree that “at the time of the collision” Nancy and Zachary were “aware that it was causing injury or death to Jacob and Mark Iskander.” All 12 jurors said yes. Jurors also awarded Nancy and her husband, Karim Iskander, $8 million in past damages and $51 million in future damages for Mark’s death and $6 million in past and $42 million in future for Jacob’s death. The jury sided with the plaintiffs on every question, including answering “no” when asked if the intersection where the crash occurred, Triunfo Canyon and Saddle Mountain Drive, was “in a dangerous condition at the time of the fatal collision.” The damages are going to increase because jurors unanimously agreed Erickson and Grossman acted with malice or oppression (or fraud for Erickson), which opens them to punitive damages. if these were just every day people with regular jobs, they couldn’t possibly ever in their lifetime come up with that much money so the fact that the jury is awarding this much money because it’s Rebecca Grossman and an ex baseball player ? it’s the same thing ,they do not have that kind of money. It’s sad, but it’s a ridiculous amount ..there’s hundreds of people who lose their loved ones from drunk drivers and they’re never awarded anything close to these figures!? it’s super sad , the loss of the kids, but it shouldn’t be about large numbers of money that people will never be able to pay or can’t pay. 💔🤔
