CALIFORNIA TOW LAW — CAN / CAN’T DO CAN DO: • Tow with a lawful legal basis. • Tow from private property with written authorization. • Charge lawful tow/storage rates. • Charge up to half the tow fee if the car is hooked but not removed. • Require proof that you own or are authorized to pick up the vehicle. • Store the vehicle at a lawful storage yard. • Charge storage after the vehicle is actually stored. CAN’T DO: • Tow without written authorization. • Hide who authorized the tow. • Hide the reason for the tow. • Hide the observation time or authorization time. • Refuse an itemized invoice before payment. • Refuse cash or a valid credit card. • Demand “cash only.” • Overcharge beyond approved rates. • Hold personal property hostage. • Charge you to inspect your vehicle. • Refuse release if the car has not left the property. • Charge full tow fee if the car was only hooked. • Store the car more than 10 miles away unless law enforcement approved it. • Skip law-enforcement tow notification. • Tow from a free public parking lot within 1 hour unless it blocks access, is in a fire lane, near a hydrant, or in a disabled space. BOTTOM LINE: Tow companies can enforce lawful tows. They cannot invent authority, hide paperwork, force cash, overcharge, or hold your property hostage. California Vehicle Code §§ 22658, 22651.07, 22953.
