@elizabethpaigeesq: Karmelo’s case is going to haunt me. The more I think about it, the more I come back to one question: why didn’t his attorneys have him testify? Of course I understand (and wholeheartedly say with me entire chest) that it is not the defense’s burden to do anything BUT in a self defense case, that decision could be fatal. When the jury is being asked to see the world through a different person’s eyes and put themselves in a client’s shoes - taking the stand is a huge part in getting there. Well he originally had 2 attorneys that they got rid of, and then hired this attorney based off of a recommendation from Dominique Alexander. His parents gained almost a million dollars, they should have been able to hire several of the best attorneys in Texas to try and make up a defense in a case that didn’t have one. But they went the cheaper route.

My sista as a fellow litigator, I agree with you that I would have put him on the stand. But the justice was not blind in this case nor in others. Rick Chow didn’t testify in his trial and was found not guilty. It doesn’t mean that was the right move to make either. This case was doomed on a multitude of different levels.

Charitable read for defense team would be they deviated while rehearsing testimony as they realized he could not communicate in a way that came off sympathetic, likely because he isn’t. Charitable read for Anthony would be that his defense team was incompetent. Anthony’s lead defense counsel is experienced and on faculty at SMU Law, so I tend to err towards the former read.

I believe there is no way he would have helped the defense. I don’t think he could have come off as remorseful or sympathetic to the jury and his attorney knew this.

Do you know that his attorney advised him not to testify? I understand that sometimes your clients listen to you when you give advice on that, I also know that sometimes they don’t listen too. The decision to testify rests solely with the defendant in consultation with their attorney. But the decision is up to the defendant, always. In my jurisdiction we do a colloquy on the record so the defendant understands the decision for testimony rests with them.
