Patrolman Arthur Gant from the Point Pleasant Beach Police spotted a white 2019 Nissan Altima sedan. The car rolled right through the stop sign at River Avenue and McLean Avenue. He flipped on his emergency lights for a stop. But the driver kept going south on River Avenue. She finally pulled into a parking lot. There, she parked the car all wrong in the space. The driver, Nicole, stepped out. She ignored Patrolman Gant's order to sit back inside. While talking to her, Gant smelled alcohol. He saw clear signs she was impaired. Nicole said she was heading home from work. She tried to walk off from the stop. When asked for her papers, she handed over PBA cards instead. She added that her dad and uncle both worked for the Newark Police. Sergeant Thomas Hayes showed up soon to help. Nicole owned up to drinking earlier that night. So Gant asked her to do some sobriety tests. He began with the alphabet. Nicole couldn't finish it right. Next came the one-leg stand. She didn't lift her foot correctly. Her counting went off track too. Then the walk-and-turn test. Nicole missed touching heel to toe each time. She wobbled and lost balance. Last was the horizontal gaze nystagmus check. Gant noted no smooth eye movement. There was jerking at the edge and it started before 45 degrees. Her shaky driving, the impairment clues, the booze smell, and the failed tests all added up. Nicole got arrested for driving while impaired. After that, her car went to All Time Auto Body. They held it for 12 hours under John's Law. Officers took her to the Point Pleasant Beach Police station for more steps. At the station, they read her the standard rights for drivers. Nicole refused a breath test. She skipped the questions too. Once processed, a sober friend took her home. He signed the liability form for her. She waited for court from there. Patrolman Gant gave her these tickets: operating under the influence (39:4-50), consent for breath samples (39:4-50.2), reckless driving (39:4-96), and ignoring a stop sign (39:4-144). Court papers show Nicole pleaded guilty to the DUI on April 4, 2024. For it, she got an ignition lock for three months. She spent 12 hours at a driver resource center. Fines hit $640 total.
