I just don’t understand why the judge would use 47.1 to award her attorneys fees when he was so reluctant, as a New York judge, to use a California law in the first place 🤷🏽♀️

the words "reasonable" and "blake lively" should not be said in the same sentence 😂

A thought: It was worth the attorneys fees to have the website with context and facts to reference in the face of that NYT article.

She got an order saying she gets her fees reimbursed for ONLY that part of the case (MTD on wayfarers claims). She is not being reimbursed for her entire expenditure for this case. It’s a small snippet.

The PR spin is all she has. Because a couple hundred thousand dollars when you spent likely over $10M doesn’t sound great in headlines.

I don’t even agree with the judge. What exactly did she do to prove she did it without malice if there was no trial or a complete discovery? Isn’t that a requirement for 47.1 to apply?

studied law in the UK but didn’t go on to practice. This is by far the best explanation I’ve come across of why attorney’s fees (or legal costs) are awarded: to put the defendant back in the position they were in before. That said, I disagree with Limens interpretation of the law. 😳

Is page six accurate about her being able to seek damages another way? Doesn’t their settlement prevent that?

What do you see her pursuing in California now that her lawyers are indicating they are going down that road to get damages.

She lost the part that could’ve allowed her to recover millions. She won atty fees for getting the defamation claim dismissed but that’s miniscule in comparison. She settled for nothing & lost damages.

She’s saying Jed Wallace should pay her $800k for her MTD against him (which he’s currently appealing so don’t get how she can claim fees when appeal is in progress). But I digress- I am interested to see what the fees are. Also the MTD addressed multiple claims WF made against Lively so she should only be compensated for the pages within the MTD addressing defamation.

I wonder if Wayfarer knew and was willing to pay for her attorneys fees, knowing it was probably going to get dismissed in order to get their information out there. Also, what is considered reasonable? Is there a cap on the amount because she arguably has some of the best attorneys and they cost more than a public defender? Does it matter who she hired and what she spent or is she to be made whole regardless?
