That makes no sense even if it’s true. Because under the doctrine of provoking the difficulty of causing Cyrus to point that gun, if a defendant like Chow creates a situation that made Cyrus attack him and Chow kills Cyrus, Chow is guilty of murdering Cyrus. This is the same doctrine the used against Karmelo. Apparently, Kent ask the court for an abandonment instruction, but neither Andy Chow or Rick Chow testified that Rick abandoned his pursuit of Cyrus.

Rick Chow also never said he saw a gun pointed at his son. He said "I didn't see the gun initially, my son alerted me that he had a gun, and then I looked at his right hand and I saw he had a handgun in his hand. So as my son was trying to reverse from him I tell him to drop it, but he didn't drop it so I fired one shot." The only time anyone said a gun was actually pointed at Andy was in the courtroom at trial, by Andy Chow himself. Regardless, self defense probably should have failed due to the Chows bringing on the dangerous situation themselves by chasing Cyrus.
