@local_lezbian: This is not ok. They took advantage of us. This company better do the right thing this time around or I will make it my goal to ruin them.

As a litigation paralegal document everything. Get an affidavit from the mason. Then call another someone (hvac) to come and inspect as well and have them sign an affidavit. This could be headed for a law suit

I believe they should have needed a permit to do that work, which means there should have been an inspection done by the Building Department. Perhaps you can take that route, because it shouldn't have passed inspection if it wasn't installed properly.

Engineer here. (1) take photos of everything (2) get the mason to provide you with a letter stating what he observed including date and time of his inspection. (3) Find your contract and any receipts from the original installation. Good luck, and I’m sorry this happened to you.

story seems odd. sounds like you bought a 100 year old house with an old chimney that was probably poor condition to begin with but somehow is the the new furnace fault? your old furnace was probably the same furnace efficiency, causing the issue to begin with. doesnt seem like the hvac company is entirely at fault

Find your local contractor licensing board and file a complaint against the HVAC company. They should be able to help you get them to correct it

They (your insurance carrier) should be able to file a subrogation claim against the hvac company

But if the previous furnace had been running into the chimney online for all that time before the last three years, then the chimney was damaged far before you got this new furnace

That’s even more frustrating than going to the mechanic and them telling me I need new tires or a new air filter or blinker fluid because I’m too dumb to know better. (That’s a joke, I know there’s no air filters in a car) bring me back for pt 2!!

They also have insurance for liability and completed products. Or should. Just an fyi, you can ask for an insurance binder from companies and then you have all their information if they fail to do what they’re hired for. I hope they do the right thing

I think you need to get a lawyer and get money to have another company repair this.

as a hvac business owner, some of what you just said made my eye twitch. I know what you meant, but it was not said correctly. I would also like to see pictures of the entire furnace and venting to the chimney.

So was the correct permits pulled by the installing company and was this inspected by the city or county to close the permits? You would likely need both gas and electrical permits on that install and if it was inspected how did it pass?

Call your realtor to get suggestions on companies to do work on your home. They usually know all the great ones to work with AND the ones to stay away from.
