Apart from the Finace Bill 2026 that is being voted today by parliament that has so much of our attention. There is another bill that caught my attention especially after hearing about the proposed tightening ban on shisha. I came across the Tobacco Ammendment Bill which is also in its final stages awaiting public participation on June 25th. Many people think this Bill is only about tightening the ban on shisha. It is much broader than that. Under the proposed Tobacco Control (Amendment) Bill, 2024, Parliament seeks to expand the definition of tobacco and nicotine products, bringing more products such as vapes, nicotine pouches and other nicotine formulations under stricter regulation. The Bill also expands the definition of smoking beyond the traditional understanding of merely inhaling or exhaling smoke. One of the most controversial provisions is Section 14J. This section prohibits tobacco or nicotine products that contain additives resulting in a "characterising flavour." In practical terms, this could affect flavored cigarettes, flavored shisha, flavored vapes, flavored nicotine pouches and flavored e-cigarettes. Anyone who produces or supplies products that fall within the prohibited category could face a fine of up to KSh 1 million, imprisonment for up to 2 years, or both. The Bill also targets how these products are sold. Section 19A proposes a ban on online sales of tobacco and nicotine products. A seller who violates the provision could face criminal penalties. The Bill also introduces restrictions on hawking, mobile vending and sales from vehicles, effectively pushing the trade into fixed retail locations. For small traders, the biggest change may be the proposed Section 20A. It requires anyone intending to manufacture, distribute, store or sell tobacco products to obtain a licence from the County Government. The licence is tied to a specific physical location, meaning a trader cannot freely move and sell products elsewhere without compliance. The Bill further introduces a product approval system. Under proposed Sections 14G, 14H and 14I, tobacco and nicotine products must be approved by the relevant authorities before being sold. Products not approved could be removed from the market, while manufacturers, importers and sellers would be required to comply with the approval framework. Supporters argue these measures are necessary to protect public health and reduce youth access to nicotine products. Critics argue that the Bill risks overregulation, increases compliance costs for legitimate businesses, creates barriers for small traders and may discourage investment in emerging nicotine industries.
