I think that if you are carrying a gun and fire upon an unarmed man who hasn’t even touched you, you have attempted murder and should be so charged, and in this case charged with murder since your victim died. I am pretty sure that if the culprit pulled the gun and fired a shot in the air his victim would have stopped in his tracks. You could plainly see him pull the gun in immediately start shooting multiple shots. That is premeditated!
