My less charitable reading of the situation is that she doesn’t want to sue the newspaper because it has more resources. As opposed to Jane Doe, where they can essentially countersue and require that she pay for a lawyer.

Wouldn't suing the NYT give Jane Doe an incredible boost in her defense as anything the NYT would do would benefit her as well? Essentially giving Jane Doe and a powerful legal ally with much more resources?
