Dr Hlophe is wrong. President Ramaphosa is challenging a panel report not Con Court ruling. If High Court review and set aside the panel report impeachment can’t continue.

Hlophe is misinterpreting the whole issue. Ramaphosa is not against what the concourt has ruled. Ramaphosa is interdicting the impeachment process while the report of the independent enquiry is being taken into review.

Hlophe clearly does not know the law the president is not reviewing or interdicting the order of the concourt, the President is seeking to review the section 89 panel report and also interdicting parliament impeachment committee fro doing its work until the section 89 report matter is settled

the matter was taken to concourt for whatever reasons, but apex court did not deal with merits of that case but said parliament deals with impeachment process. President has the right to take the Ngcobo report on and subject it to judicial review based on administrative law.

The same concourt said unless the report is set aside.

“In South Africa, a lower court cannot overrule a higher court. Under the doctrine of stare decisis (the rule of precedent), courts are strictly bound by the decisions of higher courts within the judicial hierarchy. The only way to overturn a higher court's ruling is to appeal the decision to a higher court.”

President is challenging panel report not Concourt. remember the president challenges the report immediately after it was released but halt it waiting for Concourt results

Goodmood@2030 :
The South African Court Hierarchy. Court in South Africa operate in a strict pecking order. Lower courts are obligated to follow the legal precedents set by the superior courts above them: Constitutional Court: 1The highest court in the country for all matters. Its decisions are binding on every other court. 2.Supreme Court of Appeal (SCA): The highest court of appeal for non-constitutional matters. Its rulings bind all 3.High Courts and lower courts. High Courts: Binding on all lower courts within their jurisdiction. 4.Lower Courts (Magistrates' Courts): District and Regional Magistrates' Courts must follow the rulings of the High Courts, the SCA, and the Constitutional Court

Ramaphosa is doing delaying tactics here. The biggest challenge for Ramaphosa is for the committee members to have an access to his statement that his submitted to the Chief Justice Ngcobo panel. The statement will definitely be leaked to the media houses and it will question on how the Public Protector exonerated him in her investigation.PP is next to be impeached, mark my words.
