The California judge who will decide whether probable cause supports the capital murder case against singer David "D4vd" Burke saw photographs today (Tuesday, July 21) of victim Celeste Rivas-Hernandez's body and heard testimony about the investigation into her murder. Burke, 21, is charged with first-degree murder, continuous sexual abuse of a child under the age of 14 and unlawful mutilation of human remains. He faces a possible death penalty if convicted of the murder charge under three special circumstances: lying in wait, committing the crime for financial gain and murdering a witness in an investigation. Prosecutors in some states charge criminal defendants by grand jury indictments, which involves presenting preliminary evidence to a grand jury that decides whether probable cause exists to charge. Other prosecutors in states such as California charge through a filing known as information, then a judge hears evidence at a preliminary hearing to determine if probable cause exists. That's what Los Angeles County Superior Court Judge Charlaine Olmedo is doing this week in Burke's case. The photos of Celeste’s dismembered remains were entered as evidence during testimony from the first witness, Josh Byers, a detective with the Los Angeles Police Department. Byers testified he believes Burke was the last person to drive his Tesla before Celeste’s remains were found in the front trunk, according to journalist Nancy Dillon with Rolling Stone. Prosecutors also showed police video from a body-worn camera of Burke telling a detective in February 2024, "She told me she was 18. Everybody's telling me she was 13." According to the Associated Press, Los Angeles County Sheriff's Deputy Juan Gonzalez, whose body-camera video was shown, testified that Burke had been extremely co-operative when he visited in 2024 to look into the missing person's report from the sheriff's department in Riverside County, where Rivas Hernandez lived." Burke allowed Gonzalez to search the house, which was owned by Interscope Records for its artists to stay at, and Gonzalez and his partner found no signs that Rivas Hernandez or any girl had been there," according to the AP. "The mood was friendly and jovial among the three, and one of the deputies says 'Ohhh, that's pretty cool, good for you,' when Burke described his music career." Los Angeles County District Attorney Nathan Hochman told reporters outside the courthouse that prosecutors will call more than 10 witnesses. #law #crime #court
