But if i load modded minecraft and it loads i can wait a while depending on how big the modpack id

Software Engineer here. I've worked with several UX/UI Designers, and I can respect the psychological behind design choice, however, at the end of the day, we can't control the fact that your internet connection is terrible. We don't set the spinners by seconds, we set them by loading states. The spinner often changes by the change of state in the application, which is based on the users internet connection.

Well you don't always know the API response time. Multiple factors could take it from under 1 second to >10 seconds, be it server load, poor internet, payload size, background tasks etc. That's why loading is determined by a state, not a set timer.
Bottom line, I'd rather have the spinner, let it flash for 50ms when API response is quick, and it be present when the API response time will inadvertently be >5 seconds, than to lack it with the hopes that my response time will always be <1 second which can't be guaranteed.

If it's for a website, you don't always need a spinner or progress bar at all. You should be fully optimising your code and hosting it on low latency servers
