If someone has exclusive, continuous possession of land for at least 12 years, without paying rent, signing a lease, or acknowledging the owner's title, they may be able to claim ownership. Now here's the tax twist. Normally, tax applies when property passes from one person to another. Tax law needs a disponer and a recipient. But after 12 years of adverse possession, the original owner's right to the land can be completely extinguished. So who is the disposer? That's the problem. Under current legislation, there may be no identifiable disponer at all, meaning there may be no tax charge when title is acquired. Sounds simple? It's not. You'll need to register title with the Land Registry, make a Revenue submission, and make sure the legal requirements have been met perfectly. Revenue can challenge these claims, so don't assume this is a free pass.
