What happens if there is a 6-month gap between the lead applicant becoming eligible for ILR and the dependant completing their 5-year qualifying period?
For example, if the lead applicant obtains ILR now, but the dependant still needs another 6 months to complete the 5-year residence requirement, the dependant would need to apply for a dependant visa extension. As I understand it, this extension is usually granted for 3 years.
In this situation:
1. Can the dependant apply for ILR as soon as they complete the remaining 6 months and reach the 5-year qualifying period?
2. If the dependant is granted ILR after only 6 months of a 3-year dependant visa extension, can they receive a refund of the unused Immigration Health Surcharge (IHS)?
3. Are any other visa application fees refundable, or is only the unused portion of the IHS refundable?
I would appreciate clarification on how this works in practice.
