The Supreme Court just decided the birthright citizenship case. Almost no one is telling you this: the entire ruling turns on how this country treated Native Americans. The Court held that children born here to unlawfully or temporarily present parents are citizens at birth, and rejected the executive order. It all came down to one phrase: "subject to the jurisdiction thereof." To define it, the Court went straight to the history of Native nations. For centuries, birthright citizenship applied to almost everyone born on a nation's soil. There were two exceptions: children of foreign diplomats, and Native Americans. Native people were excluded for one reason. Tribes were sovereign nations, and a person born into a tribe owed allegiance to that nation, not the United States. Not ancestry. Sovereignty. That is why it took the Indian Citizenship Act of 1924 to make Native people citizens of their own homeland. The Court used that exact history to reject the government's argument. The Native exception proved the immigrants were included. Native American history is not a footnote in American law.
