*Bakit ganyan ang batas*
1. *Below 15 - exempt sa criminal liability*: Kahit murder/rape, hindi siya “kriminal” sa mata ng batas. Ang ginagawa: CICL = Child in Conflict with Law. Route ay intervention, counseling, Bahay Pag-asa, IJIRC. Max stay sa facility usually until 18-21 depende sa offense at assessment. Wala talagang kulong na katulad ng adult.
2. *15-18 with discernment*: Criminally liable na, pero “suspended sentence” pa rin ang default. Ibig sabihin hindi agad kulong. Dadaan muna sa diversion/rehab. Kung mag-fail o gumawa ulit ng serious offense, saka lang i-impose yung actual sentence. Pero juvenile facility pa rin, hindi Muntinlupa/Bilibid.
Yung galit ng tao valid talaga. Yung “deemed rehabilitated” standard ang masakit sa side ng victims. Para sa pamilya ng namatayan, lifetime yung loss. Para sa bata, may legal path pabalik sa society pag 18+ na at may assessment na “fit to reintegrate” na.
*Yung debate ngayon*: Kaya maraming push na ibaba yung age of criminal liability to 12 or 13, lalo na for heinous crimes. Pero kontra naman ng child rights groups kasi studies show kulong sa bata = higher chance mag-recidivate paglaki.
Wala talagang perfect answer dito. Rehab vs justice/retribution lagi magbabangga.
