“The mere non payment or incomplete payment of bride price does not extinguish paternity once accepted and acknowledged by both the claimant and the defendant” This was part of the verdict of the court . This is my opinion on this “ It is unlawful for the defendant to subject the claimant to marry a deceased woman on the face of the law but the failure by the claimant in partial payment or non-completion of the bribe price of the deceased raises a controversial issue in law as to the legitimacy of the children “ it is undoubtedly that the failure or non payment of marital obligations doesn’t extinguish paternity of a child but this issue raises another question as to whether the children will be the legitimate children of the claimant in the face of the law which confers the right of the children to acquire the family name of the husband ONLY after full payment of marital rights have been paid to the defendant family “ At this juncture, I hold the view that , the children of the claimant shall be illegitimate meaning that , the children will not bare the name of their father unless marital obligations are fully paid while condemning the decision of the defendant to marry a deceased person “

I disagree ooooo .... it's not called "marrying the dead" instead completion of marital obligations... so he is under obligations to complete the rites before taking custody of the children. no one is arguing that fact. if those kids are handed over to him, he won't complete that but remarry
