sorry any defection should result in a by-election regardless of party. they was elected on a party mandate. Burnham was actually elected on the Labour Manifesto. so he has a mandate. the prime minister comes from the elected government's party leader. labour was elected as government, hence the labour leader becomes the prime minister and run on the winning manifesto. which means Burnham has to run and lead on that manifesto.
