@bradbernsteinlaw: The Supreme Court ruled 6-3 that certain returning lawful permanent residents can be treated as applicants for admission and paroled into the U.S. instead of being admitted, even where the criminal case was only pending at the time of return. The case involved Muk Choi Lau, who later pleaded guilty, and the Court said the government did not need an extra “clear and convincing evidence” burden at the border beyond what the statute requires. Practical point: A green-card holder with criminal charges should be very careful before traveling abroad. Love that you are giving great updated information … even though my husband is a very recent green card holder with a clean background I never pass up an opportunity to stop and listen to you …I learned so much from you while going through his our process and it helped me set him up to have a successful approval… especially after basically being abandoned by the lawyer we did have so I had to step up and take over!!! I continue to listen and learn from you and your knowledge is so important valuable and appreciated!!! Keep up the great work sir… there are people listening !!!🥰

What do you recommend that a green card holder do before traveling internationally

It’s not recommended under no circumstances to travel outside the US if you have those kinds of issues, talk to a lawyer before making any decision.

My thought of process on this one was that even a regular citizen is told not to leave the city while charges are pending.

what is this supreme court doing? at this point they should be part of the legislative body, they are coming up with brand new laws in the guise of 'explaining' what current laws are

Most lawyers on here are straight up saying CBP will put you in removal proceedings based on pending charges. Thank you for not blasting that lie. They will parole for deferred inspection, but only place in removal proceedings if convicted. Not to mention, this has been the status quo ever since IIRIRA, BIA Valenzuela Felix was the precedent for YEARS before the 2nd circuit.

speaking to a lawyer doesn't matter, immigration law is a immigration law so lawyer cannot twist it in any way. They just take peoples money.

It should be only for crimes involving moral turpitude.... but it also says if the officer *feels* like there is cause 😭

I'm not sure what's knew about the ruling but they've been doing that for the past 30yrs. I know of people who were refused entry after traveling because of arrests. Some didn't even have criminal records, they were being denied entry because they did a check and saw that the person has never had a job after yrs of living in the US. Maybe this ruling was to make Trump believe he won, but whether it was official or not they were already doing this.
