A New York judge ruled today that jurors in Luigi Mangione's state murder trial over the fatal shooting of UnitedHealthcare CEO Brian Thompson won't see a gun magazine, phone, passport, wallet and computer chip that police found in Mangione's backpack at a McDonald's in Altoona, Pennsylvania. Judge Gregory Carro suppressed the evidence because he determined police obtained it through an "improper and warrantless search." Carro also ruled, however, that police acted lawfully when they searched Mangione's backpack later at a police station, so items found then, including a gun and a notebook, can be presented as evidence in trial. The judge issued his 17-page ruling this morning before Mangione appeared in his courtroom for about 15 minutes. Mangione’s lawyers wanted the judge to suppress all evidence obtained by Altoona police officers, who approached Mangione on Dec. 9, 2024, about 9:30 a.m. after an employee called 911 and said he looked like the man wanted for killing Thompson five days earlier in New York City. Judge Carro agreed the search at the restaurant was illegal because Mangione was not in control of his backpack, nor was it within his reach, and even if it was, police "did not meet their burden" of establishing they needed to search it for weapons. But he said the searches at the police station were properly conducted as “inventory searches,” which means the 9 mm gun was properly seized and can be used as evidence. The judge ruled that Mangione's responses to officers' questions before he was told of his right to remain silence, can’t be used at trial. You can find a link to the order in my profile.
