I think Jury’s should be made up of professional jurors or law students. Jury of your peers is outdated especially how complicated our laws have become. Just look in any comment section everyone has a different opinion of how things should be applied. And people are able to be swayed by a good lawyer rather than the facts of the case. I was on a jury once, and even the “jury instruction” part was confusing.

I really do not like that they have the same jury that convicted them also sentence them in the same day that they have convicted them. In my opinion, after the trial and deliberating for the conviction, most likely they are worn out and just want to go home. I do not feel their input is a great way to go, knowing they just want to be done and go home. I feel like it should be 2 different juries or a judge doing the sentence after conviction has been decided once they are able to review previous history, current crime they were convicted of, and whether or not the individual can be rehabilitated. I strongly feel that not all of it should be done at the same time. There has to be time between conviction and sentencing so people can be prepared to give impact statements, the person convicted can get their thoughts together to speak on their own behalf, and the judge be able to review case law and similar crimes.

I guess that’s why in Texas the defendant has the choice to choose the Judge or Jury to sentence.

it's had to have the conversation of rehabilitation through the justice system when the entities themselves (the jails) are privatized

This is true but it’s also the convicts choice to be sentenced by the judge or by the jury and the lawyer should inform them

Law school taught me the deterrence factor wasn’t limited to the defendant in a particular case but to also similarly situated defendants. One of the worst things that Texas’s jury sentencing plus Texas’s huge ranges for potential sentences really allows for unjust disparate outcomes.

Well explained as usual. I’ve thought about this before to say what is the goal or purpose of a particular sentence? What is the system trying to achieve.

U can opt for the judge or jury. Just watched a jury trial here yesterday, he was found guilty by the jury, and the judge sentenced him. Totally up to you.

I agree with you because the jury is not educated in the sentencing process instead the decision is based on personal opinion. My thoughts.
