Title: People v. Abella G.R. No.: 127803 Date of Promulgation: August 28, 2000 Ponente: Davide Jr., J. In People v. Abella, appellants Juanito Abella, Diosdado Granada, Benjamin de Guzman, and Edgardo Valencia were convicted by the Regional Trial Court of five counts of murder for the abduction, torture, and killing of Marlon Ronquillo, Joseph Ronquillo, Erwin Lojero, Andres Lojero Jr., and Felix Tamayo on March 8, 1992, whose bodies were later found floating in the Pasig River. The prosecution established that the abduction stemmed from a basketball altercation days earlier between the victims and the De los Santos brothers (JOEY and GENER), who later pointed out the victims to the appellants and their cohorts. Witnesses Josephine del Rosario and Evelyn de la Cruz positively identified the appellants as among those who abducted the victims from Lakas Street, Sta. Mesa, Manila, with Josephine recognizing Granada by his prematurely graying hair and Abella as the "good-looking guy" with no face cover. Prosecution witness Elena Bernardo, a fellow member of the Iglesia ni Cristo, testified that she saw the appellants and their cohorts bring the victims to the basement of the INC compound in Punta, Sta. Ana, where they were mauled, beaten with lead pipes and blunt instruments, and tortured. The victims' hands were bound, and they were later thrown into the river. The Supreme Court affirmed the conviction, ruling that the positive identification of the appellants by prosecution witnesses, who had known them personally, prevailed over their defense of alibi. The Court held that Elena's testimony, despite some discrepancies (such as her mistaken claim of stabbing), was credible and corroborated by other witnesses and autopsy findings showing contusions and hematoma from blunt force injuries; the maxim falsus in uno, falsus in omnibus does not apply where false portions could be innocent mistakes and where testimony is corroborated. The Court found that the circumstantial evidence—the altercation, the stoning of the Ronquillos' house, the abduction witnessed by multiple persons, the torture inside the INC compound, and the recovery of the bound bodies—constituted an unbroken chain pointing to appellants' guilt. The killing was qualified by treachery, as the victims were bound and rendered defenseless before being killed. Voluntary surrender was not appreciated because appellants went to the police only to "clear their names," not to submit themselves unconditionally. The Court modified the damages: the awards of moral and exemplary damages were reduced from P500,000 to P50,000 each, while the death indemnity of P50,000 per victim and actual damages were affirmed. The case reiterated that alibi is the weakest defense and cannot overcome positive identification, and that physical evidence prevails over conflicting testimonial evidence.
