well actually as the oldest living child of Jaeherys eldest son Aemon Rhaenys claim would have come before that of Baelon his third born son. So by bypassing the legal succession of Aemon to Rhaenys in favour of Baelon. Jaeherys was setting a precedent of a king choosing his own heir outside of the legal line of succession. A choice that was later affirmed by the various Lords of Westeros in the great council of 101 A.C. Effectively what the Lords of the realm agreed to was the King had absolute perogative to name his own heir how he sees fit. A custom that was FOLLOWED by Viserys I when he named Rhaenyra

Viserys explicitly named Rhaenyra his heir, had the lords of the realm swear oaths to uphold her succession, and never revoked that decision. if kings had no authority over succession, those oaths would’ve been meaningless. The Maegor and Aerea example isn’t directly comparable. She wasn’t rejected because “kings can’t name heirs” she lost because Maegor was widely viewed as illegitimate.

Jaehaerys broke the laws twice. Once when he usurped his niece's Throne, which is against the Westerosi and andal law, and when he broke the Westerosi and Andal law and named Viserys his heir. Hence he created the possibility of the King naming his own heir, which is what Viserys used.

This is just wrong, kings can absolutley choose their heirs hower they want. Aera did not succeed Maegor because Jaehaeeys technically usurped her by flying to Kings landing first after Maegors death.

westeros has no codified succession laws. the kings heir is whom they name their heir. moreso the kings word is law. the entire realm made vows to rhaenyra are heir to the throne and those that backed aegons usurption broke those vows they made before gods and man.

in an absolute monarchy the king is the law and the king himself get his powers from god/the gods. the king has all three powers + military command in his hands and can eventually delegates them to subordinates (ex the small council o the early parliaments in real history). and this happens also (it’s even more pronounced) in a society without precise or written laws, like westeros. so the king can decide to change the succession law and design lawfully an heir, unless his vassals doesn’t agree (something they did not do, however, as they kneel to rhaenyea two times during viserys reign). if someone think he can challenge the king’s power (and so the gods) he must conquer it with the support of an higher position (the king or the gods again) or with military power, that is what happens in hotd. however until they don’t conquer this power they are opposing the king’s law and so are legally considered outlaws
