Texts, Discord chats and photographs of notes will be displayed in the courtroom during the the preliminary hearing against Charlie Kirk's alleged murderer, a judge ruled today. Erika Kirk's lawyer again urged Judge Tony F. Graf Jr. to allow all exhibits to be displayed in open court so that Erika and Charlie's parents, Robert and Kathryn Kirk, who are in Graf's courtroom in Provo, Utah, can see the evidence against Robinson and understand what the judge is considering when determining if probable cause supports Robinson's charges.

"The Kirk family's waited 10 months for this hearing, and they have a right to be here, and they have a right to hear the evidence. They have a right to see and feel what's going on in this courtroom," said Jeffrey A. Neiman, a partner with Neiman Mays Floch & Almeida PLLC in Fort Lauderdale, Florida. "We understand you have to balance, but at a minimum, this courtroom needs to be open for the evidence to be displayed openly in this courtroom for them to see it. The Utah Constitution gives them the right to be here. And to be here and not to see the evidence, what's the point of being here? We ask you to let the evidence be seen in the courtroom, please. Thank you for your time," Neiman continued. He added later, "This has not been easy, as you can imagine, and I think the family deserves to see the evidence that's been gathered in this investigation. They deserve to know what happened, Charlie. So we urge the court to please again display the evidence here on the court." Judge Graf agreed the exhibits - 16.1 is texts, 16.2 is Discord chats and 16.3 is photos of notes - should be displayed in open court. He said he's not persuaded that doing so "creates the type of inherent or presumed prejudice that requires category categorical restrictions under" case law. The exhibits in Robinson's case differ from a previous case because "the exhibits at issue are written communications allegedly made outside police custody and are being offered in the ordinary course of a judicial proceeding." "That distinction does not eliminate the possibility of prejudice, but it weighs against treating publication of the exhibits as presumptively unconstitutional," the judge said. Any potential prejudice can be remedied "through the appropriate trial procedures, including voir dire and any other measures warranted before trial."
