A Utah police officer testified today that he saw a pistol holster lying in the grass of a Utah Valley University courtyard after Charlie Kirk was shot to death, but he realized at the same time that the gunfire he heard came from a rifle. Chris Bagley of the Spanish Fork Police Department said police mistakenly thought they had apprehended the gunman moments after the shooting, so he was trying to protect the crime scene by clearing people out of area when he saw the holster.

Chris Bagley of the Spanish Fork Police Department said police mistakenly thought they had apprehended the gunman moments after the shooting, so he was trying to protect the crime scene by clearing people out of area when he saw the holster. "Things had died down just a split second. I realized that the shot I heard was more of a rifle shot and not a pistol shot," Bagley testified. Chad Grunander, the chief deputy attorney in Utah County, asked Bagley why he thought so. Bagley said a handgun "is more of a short bang pop sound." "With a rifle, you have a more of a longer violent bang or crackle sound. It's more of a violent kind of sound. It's longer, that's why I recognized it," Bagley testified. He said the moment he saw the empty pistol holster, "I turned to my chief and I said, 'That was, that was a rifle shot.' He said, 'I agree,' and I looked up at that moment, right in the line of sight. I could see the Losee building had a direct line of sight, so I proceeded to go look at that and see what was going on up there," Bagley said. He got to the rooftop of the Losee building at 12:44 p.m. and noticed "an object which was sitting right about 10 or 15 feet in from the other side of the guardrail in the gravel that looked out of place to me."
