What if 16 years ago they went to court, a county court judgement was made against you, but they have failed to collect and you’ve never acknowledged the debt ?

but is not classed as harassment, when they keep on sending someone letters every month, about a debt that no longer exists?

Surely you are acknowledging the debt if you ask them to stop

Could you give me some advise please? I have had a repayment plan with Pay Plan since I split with my husband in 2008/2009. Several of the debts have been sold on over the years but Pay Plan have always dealt with the debtors I just pay a small amount to them each month and they sent on to the debtors. is there anything I can do?

Can they still contact you even though the debt was included in a bankruptcy 7 years ago? And do you have any advice regarding hmrc and debt that was covered in bankruptcy?

Hi,in 2018 I went to prison, nothing I could do to pay my debts. I was released after 3 years and after around 4 months I started getting letters. I haven't contacted them even though I still get letters after 5 years out of prison. The only debt I have paid was a ccj which was an attachment of earnings. What do I do please, appreciate your time

jp.tiktok007 :
It’s virtually impossible. If the ccj is over 6 years it’s very rare a court would allow it. It’s also very rare that a creditor would take you to court after 6 years as they know they will lose. More costs. It’s extreme circumstances.

Can they still send letters tho? Can’t you say it’s harassment?

robdabank86 :
the claim of debt is statute barred. there is no legal recourse to utilise and as such the continuous request is paramount to harassment and as such any further contact from the company will potentially trigger either a cease and desist a restraining order for harassment or a litigation lawsuit for harassment

One company has been chasing me over something that is apparently from 2001ish when I was 19. I am now 43 and the date of birth on that debt is not even mine. I have contacted them, shown my drivers license when they have knocked on the door but they just send a letter at least once or twice a year.

Question: My partners been trying to get debt help with @StepChange Debt Charity the woman wouldn’t support, told him to go contact lenders and ask for a years pay freeze to then give him time to earn more money?! He’s on a fixed training schedule at work to qualify so won’t be getting a payrise any time soon, and he tried this before contacting SC, only one would give him relief and it was for one month, he doesn’t own a home to be suitable for an IVA, he’s a veteran, but the veteran charities can’t help, we feel he would be best suited to a debt relief order as he meets all the requirements but SC won’t engage other than telling him over and over to ask companies for a pay freeze despite us saying we have and they declined, they are gatekeeping the support of debt relief order which the veteran charities can’t help with as they don’t have the sign off to offer it - it’s gotten worse because of how little support SC he’s been given (even hung up on once because she had finished her shift) and now heads back in the sand about it all - any advice?
