The biggest thing about this that most ppl don’t know is yes the HOA typically has a board made up of homeowners HOWEVER that does not happen until the neighborhood is fully built. Until all the lots are built/sold, the builder is the HOA. So in this case, the builder has decided to pass costs down to the homeowners and they basically have no say in it bc there is no board since the builder hasn’t turned the HOA over to the owners yet.

There are rules and bylaws set forth when the HOA is formed. But guess what, the board of the HOA can vote to change the dues, the rules, the bylaws and anything they want. In NC, there is no state governing agency that controls or caps HOA fees. HOAs have broad authority over the dues and rules.

🤷🏾♂️I have a friend whose HOA is 250/yr and she refuses to pay that. I’m not a true fan of HOA but if you have amenities such as a gym, pool, basketball court lake etc it might be worth it if the fees aren’t exorbitant

My house in Marietta Georgia had a HOA of only $200 for the whole year, we were only one street of 22 houses. The HOA fee covered the entrance to turn onto our street. We would decorate the entrance for the kids that graduated every year. I lived there for 12 years, the fee stayed $200/ year, no increases. I live in Charlotte now, and I miss my old house 🥺

Well, you can’t have a bunch of broken down cars all over the place or build anything you want on your property and have your lawn out of control in city limits anyway, so HOA in that sense isn’t any different than the city. But HOAs suck.

The HOA can always increase the fees whenever they want and charge you for special assessments if they need upkeep or add amenities its usually stated in the bylaws. Now the developer may still be the head if they plan on still building there or they specifically stated they’ll be head of HOA

There aren’t rules per se but there’s a board full of the people who live in the community who can create the rules. Each HOA is different. In this case the head of the HOA is also the developer 😳 HOAs are always bad BUT that’s why you read the rules of the HOA before buying the house/townhome

First the government can tell you want you can and cannot do with your land. Secondly whenever you buy a house in an HOA area you have to abide by their rules and regulations - if you rent in a HOA you still have to abide. As far as raising the HOA fees they had to hold an open house, have a discussion and vote … if motion passes they have to notify everyone of the new policy with start date and allow a certain amount of time for it to be challenged

There are normally bylaws that state they can only go up a certain percentage each year without a certain amount of residence approving the increase. This is a crappy situation, but it’s also on the home owners for not understanding the bylaws

Even if you’re not in an HOA the city can fine you for having too much junk in your yard…. But yes HOA fees and rules can be outrageous.
