Alito's dissent was disgusting. He basically said it's in the constitution, but it shouldn't be because it's dangerous. He has no loyalty to the constitution, only to conservatism.

Keep in mind the ambiguity stems from the phrase“subject to the jurisdiction thereof.”

That was 100% just a loyalty test for the court.

Oh a literalist interpretation. Guess we don’t even need the Supreme Court because we have a constitution

Kavanaugh's dissent/concurring is even better, since he reads the verbiage differently depending on whether it is statutory or constitutional.

It’s not 3, it’s 4. Kavanaugh chose a weird middle ground where statutory language with the exact same text as the citizenship clause was good but somehow the clause wasn’t

Trump used the EO to intentionally push the issue to SCOTUS. It was a political stunt. It was a smart move to try and pander to his base, and I think we will see more stunts Iike it from future presidents.

There is a LOT of room to question the meaning of”…subject to the jurisdiction thereof…”. You can read the Civil Rights Act of 1866… read the text of Wong Kim Ark case…

Conservatives believe the 2A must read literally and applies to current times but the 14A only cannot be read literally and it only applies to the 1860s.
