My first thought when I saw her video was that the mother is trying to push unreasonable or unnecessary accommodations through when the teachers won’t be there to disagree. I am a teacher (gen ed) and am not paid to work during the summer break. I will not be meeting over the summer. What’s best for the child in June can be discussed when school starts in August. Not to mention - class lists aren’t finalized until about 2-weeks before school starts.

As a special education teacher I am going to push back here: there are plenty of reasons that may come up where a summer meeting may need to take place. They have those people. You are only looking at it from your own personal experience. She may not have needed it. So I encourage you to dig a little deeper.

I work in public special education. There is literally no one in the buildings right now. If someone were to request an IEP meeting right now, there'd be no one there to respond.

As a special education teacher, I agree with doing what’s best for the child. However, I will not be attending an IEP meeting during the summer. Contractually, administration cannot legally force me to come in during non-contracted days. They can offer to pay me for my time and I can still tell them I am not coming in. When you look at the whole picture, it’s not just a simple meeting. It involves a formal notice of meeting that needs to be mailed home. All the documents need to be prepared for the meeting. There needs to be required team members in the meeting. The IEP needs to be updated to reflect any changes. The placement page may need to be adjusted. A prior written notice needs to be written. All those documents need to be finalized. Those documents have to go to the records department. The documents have to be mailed to the parent as well. preparing for a meeting, holding the meeting, and finalizing the documents, take a great deal of additional time. I need access to my computer, I need access to a printer, I need someone to take the papers to the district office, etc.

We’re human beings and prioritizing meeting the needs of our own children or our own health and well being during our agreed upon non-contractual time doesn’t mean we don’t care about the best interests of our students. How would we ever be able to show up for you and your kid if we don’t take care of ourselves?

As a special education teacher and parent of children with IEPs I don’t understand why you would want someone who won’t be the teacher doing the IEP meeting. Teachers aren’t contracted in the summer. The child’s teacher won’t be in the meeting which is pointless. You are spot on with how you word this.

You are absolutely right! But I have had 2 summer IEP meetings. The first one the school requested because he was going into prek3 and they wanted to do their evals and everything so the IEP was in place for the beginning of the school year. Then we just made the renewal IEP meeting in May of that school year so we would be back on a schedule where his actual team was available. The second one I requested because he was switching school districts. There wasn’t going to be anyone there that knew him regardless, so it was more so to change his IEP to suit the way the new district did things. I did say we could have the meeting early in the school year, but they were content to not have to do it in the craziness for the first week of school. So it was the principal, the SPED supervisor for the district and the summer extended school year team for specialists. But I think that one benefitted them more than me. They just made small changes like instead of 1 hour sessions a week for speech, they changed it to 8 30 minute sessions a month because that’s how their SLPs worked with the younger grades.

This is the same, totally wrong, and illegal argument schools make during the school year when they say “we can’t do that because we don’t have the staff” or “we don’t offer that here.” That is a school issue NOT a parent’s or child’s issue. And most importantly, it does not relieve the school of its responsibility to provide FAPE to a child. So just because teachers and related service staff might not be readily available over the summer and summer break presents challenges to getting the required staff to the IEP table that does not dissolve the school’s responsibility to figure it out and follow IDEA. A child’s civil rights do NOT take a break over the summer. Only in education would someone argue that a person’s civil rights can be paused. Name one other civil right where that argument would fly. And it seems you never read Letter to Reyes from OSEP, which clearly states that 34 CFR 300.301(c)(1) does not include an exception that extends the applicable timeline because of a school break. OSEP went on to state: The Office of Special Education Programs recognizes that conducting evaluation activities during extended breaks, such as the typical school’s summer vacation, can be challenging for school districts, particularly if fewer staff members are available. However, that challenge doesn’t relieve districts of their obligation to timely evaluate students so as to ensure that a FAPE is available to all eligible children.”

As a 23 year veteran sped teacher, IEP specialist, parent advocate and ASD mom I would personally feel uncomfortable being called in as a teacher for an IEP meeting for a child I don’t know. I can’t do what’s best for that child if I know nothing about them, their disability, their needs, etc. parents like her set the tone for an unsuccessful relationship between parents, school and educators. I was in the same situation as you were with my child for you with my son, aged out in the summer, evaluations and meeting in the end of August. Ready to go in September. Couldn’t have asked for a more flawless transition.

But you also need to take into account that yes you can request the meeting during the summertime, but teachers are off and not being paid so they are not putting the child needs at the end. They are just only working when they are being compensated for that work, which any employee you would do

as a teacher, I do not want to, but bc I love my babies, would I¿ if possible, absolutely. as a mom, my daughter is going back to public school after being online last year due to medical things. she needs a 504, I will absolutely have to have a meeting before she steps for into school, she has 13 diagnoses. I've already talked to the district, I'm the 504 coordinator for my building in a different district, they will absolutely do it, they've known about it for months, IDC who is there, I just need to know they will handle her currently (she has epilepsy, OCD, PTSD, pots..) there's a lot that needs to be in place day one. they will be getting coffee, lunch, something c I appreciate them
