your wrong on taco Tuesday. it was a trademark by a restaurant chain Taco John's they had the trademark since 1989 it was not new. they did not enforce it very hard or ever, but taco bell which is a massive brand wanted to have a marketing campaign with it. instead of paying a smaller brand for its use they just bullied them and launched marketing campaign against them and sued so the trademark goes away. taco bell was successful and got the trademark taken away. so it is not always about common phrase can't be, it comes down to how much money and your marketing.
