The State Attorney's Office dropped all criminal charges just days later, concluding that the sticker was protected speech and that a jury would not convict under Supreme Court precedent. Webb subsequently filed a federal civil rights lawsuit against the arresting deputy. However, a federal judge ultimately awarded qualified immunity to the officer, dismissing the lawsuit because the law regarding obscenity on bumper stickers was not deemed "clearly established" enough to hold the officer personally liable.
