I asked my copyright professor this in grad school and he said that anything related to the functional design of the item couldn't be copyrighted, like you can't copyright a hat, but that maybe some colorwork patterns could be copyrighted if they weren't related to the functional design and were sufficiently unique.

i have a question i do alot of arts an crafts i was wondering when a design or a pattern would be considered stealing? this lady i have in one of my groups posted her final project with a water trademark. While i have no intention on making the same one as she did and i would be adding my own things. would it be considered stealing if i saved it and added comments of my idea to it for my own? she didn’t have a pattern and half of it was blurred out so i would be winging over half of it. it would be for personal use not for sale or anything like that.

In your situation you describe a contract buyers had to sign not allowing them to sell. A lot of designers (especially independent designers) put that term on their patterns “items from this pattern cannot be sold” but don’t have a signed contract. My understanding was that in the US, you can’t impose those terms just by printing those words at the bottom of the pattern.

Same thing in China. Many western patterns are translated and posted openly on Chinese Rednote and Douyin. Patterns cannot be copyrighted, but how it is presented can.
