@samuelszuchan: The average national constitution lasts 17 years. The American one has lasted over 230. Three constitutional law scholars built a dataset of every national constitution adopted since 1789 and ran the mortality tables. Half don't survive past 19 years. Thomas Jefferson actually wanted exactly that: he argued every constitution should expire automatically after 19 years so each generation could write its own. Madison talked him down. France has gone through more than a dozen constitutional orders since 1789. Germany, Japan, Russia, China: each has torn theirs up and started again at least once, usually with blood on the floor. The documents that die young tend to share a build: they describe the drafters' present in loving detail and call it eternity. The Soviet constitution of 1936 guaranteed the right to work, free education, freedom of speech, press, and assembly. More generous on paper than anything in the American document. Its principal architect, Nikolai Bukharin, was arrested under it within three months and shot fifteen months later, his confession extracted while the press was still celebrating the text he had drafted. Now look at the American version. 4,400 words. The shortest constitution of any major government. It doesn't specify how many justices sit on the Supreme Court. It doesn't mention judicial review. It says almost nothing, and that is why it's still here. Edmund Randolph wrote the design rule at the 1787 Convention before the first article existed: insert essential principles only. Specify your utopia and you schedule your own funeral. The actuaries say seventeen years. Leave it vague, and the document survives by meaning whatever each crisis demands, while everyone pretends it hasn't moved.
