The cop said "It's Florida case law" but never stated what law he's referring to. Florida statute 322.15 states "Drivers are legally required to carry and present a valid driver license, along with vehicle registration and proof of insurance, when lawfully stopped by law enforcement. Passengers generally do not have to provide identification unless the officer has reasonable suspicion they are involved in a crime." So what case law is this cop referring to? 🤷🏾♂️

This is an unlawful arrest. There is no Florida case law or statute requiring a passenger to identify themselves during a traffic stop. Florida Statute 322.15 requires the driver to provide a license, registration, and insurance - passengers are not covered under that statute. An officer can ask a passenger for their name and date of birth, but the passenger has every right to decline. The only way an officer can lawfully demand identification from a passenger is if they have reasonable articulable suspicion that the passenger specifically has committed or is committing a crime - not just that the vehicle was stopped. This officer had no such suspicion and could not articulate one. That makes this arrest unlawful. The fact that people are watching this and treating it as acceptable is genuinely alarming. Learn your rights people.
