Here are the FOUR grounds that actually exist in law — verified against current Home Office caseworker guidance (18 May 2026). 1️⃣ ARTICLE 8 ECHR — Right to private and family life. This is a BALANCING exercise, not automatic. Separation hardship alone is NOT enough. Circumstances must be genuinely exceptional. 2️⃣ ARTICLE 3 ECHR (MEDICAL) — Absolute prohibition on inhuman and degrading treatment. Applies ONLY where removal creates a real risk of serious, rapid and irreversible decline in health resulting in intense suffering or significantly reduced life expectancy. Very high bar — confirmed by UK Supreme Court in AM (Zimbabwe) [2020] UKSC 18. 3️⃣ DISCRETIONARY LEAVE — Last resort only. Standard grant is 30 months. Cannot be applied for from OUTSIDE the UK. Only considered where no other ground applies. 4️⃣ COMPELLING COMPASSIONATE GROUNDS — Non- Article 8 exceptional circumstances. Usually produces a SHORT period of leave. A child's health or welfare need is the most common example.
