@nomad_1033: July 5,2026: Kuwait has introduced changes to its Civil and Commercial Procedures Law, enabling a wider group of judges to approve travel ban orders more quickly. The government has amended the opening paragraph of Article 297 of the Civil and Commercial Procedures Law, issued under Decree-Law No. 38 of 1980, through Decree-Law No. 68 of 2026 published in Kuwait Alyoum. Under the amendment, the phrase “from among its subordinate (judges)” has been replaced with “whoever is in the court,” broadening the authority to issue travel ban orders to judges appointed by the General Assembly of the Court of First Instance, regardless of their rank. The explanatory memorandum accompanying the decree-law states that Article 297 defines the legal requirements and procedures for imposing travel bans on debtors. Until now, this authority was restricted to the Director of the Execution Department and deputy judges of the Court of First Instance. The government explained that assigning the authority exclusively to deputy judges created bottlenecks due to the growing volume of travel ban applications and the shortage of judges at that level. Some Courts of First Instance lacked deputy judges altogether, delaying the issuance of orders. The amendment aims to speed up decisions on travel ban applications by enabling the General Assembly of the Court of First Instance to appoint qualified judges to review and issue orders promptly. According to the explanatory memorandum, the amendment was enacted pursuant to the legislative powers conferred by the Amiri Order of May 10, 2024, authorizing the issuance of laws by decree with the force of law. Under Article Two, the relevant ministers are tasked with implementing the new provisions within their respective jurisdictions. The law becomes effective upon its publication in the Official Gazette.
