Problem with right of first refusal is how are you going to know they are leaving the child with someone else when they lie at every turn.

Very strong list! I used to practice family law The only thing I would add is a deadline for the other side to notify whether or not they plan to exercise parenting time that falls over longer breaks or summer vacation. that way mom as the default parent in most cases knows exactly how to register for camp and Dad can't decide a week before summer vacation that he actually is or is not going to take his parents in time.

Keep in mind, right of first refusal goes both ways. If you make plans where you need childcare you will have to contact the coparent first to see if they want the kids for that time before you ask anyone else to watch your kids. It’s a double edged sword. I did not like this and it became another tool of manipulation.

Summer breaks should not be consecutive weeks! If it’s high conflict do not do right of first refusal. Must put each other on all sign ups an enrollments. Must have consent from both parties in writing. If forfeiting parenting time the other parent must pay for childcare. All medical, religious, educational decisions require consent from both parties. Put end times on vacation times not just the day. Outline extracurricular activities and out of town travel for those and who pays.Reimbursements done within x amount of days if not interest applies. If you have to file to enforce you are entitled to attorney’s fees if you served a default notice and time time to cure. Also add if the they cure only after filing but before judgement you are entitled to the costs lost. Be careful with the social media because most extracurriculars require the social media clause. The schedule should be posted . The other party must have clothing at their house for the kids. If they want the kids to go to private school they must pay for all the expenses. If they want you to live in an area closer and you can’t afford add a location fee that is enforceable like child support. It must be written that way. Be careful on the tracking issue. I use life 360 because he was leaving the kids alone and at times they were lost. Keep in mind I am dealing with high conflict.

I did that, but my attorney AND my cousin said a judge wouldn't approve half of what I drew up as a proposal, especially with the vacation stuff. My attorney said, "a judge will never approve this. Why do you need to know when and where he goes on vacation?" I said, "well, mainly if it's out of the country. I don't need details about the vacation, just general location." She said, "if something happens to the kids the embassy will have their info, or you could easily figure out where they are." Soooo, idk, I feel like my only option is to just accept the generic schedule.

How do you push for claiming them on taxes every year? I have 341 days he has 24 but judge still ordered us to switch off years. Going back to court on Tuesday bc he wants extra time but he’s only seen him twice this year !!
