In this scenario the plaintiff or the injured person cannot pursue a civil claim against the driver because the defendant or the driver is not financially liable to pay medical bills or compensation.The financial liability is absorbed by the state according to section 21 of the Road accident fund.But you are correct that a person can attend both civil and criminal case but not in this scenario

Well at UNiSA they do justice bcz u literally find this on the beginning of the study guide where they explain and define what is a delict,what is the law of delict all about ,it’s elements that must be met for an Act to be a delict and how it differs from crime or criminal law hence they all have different elements.The law of delict with 5 elements and criminal with 4 elements .Lastly on how these 2 can happen or exist in a single incident or act.

I think that's where the emphasis must be placed. There is a chapter about classification of the law and it said in Beginner's Guide for Law Students book that the classification of the law is not perfect in practice and a relatively one issue can involve many branches of law i.e public (criminal law) and private law (the law of delict). I also don't think there are any discrepancies between these two because at the end of the day the SA law is subject to one unified legal document which is the Constitution.
I'm open to be corrected, it will mean a lot.🙏

i.e. OJ Simpson case. I think in most cases, the victims are not made aware that they can sue on civil court, I find most are so invested in the criminal trial, and get frustrated because their role is so limited in the criminal case
