@pathoran: LATEST VIDEO from Patrick Horan, Solicitor. Legal Representation across Ireland specialising in road traffic offences. See website for more: http://phoransolicitors.com #Ticktocklaw #Legal #RoadTraffic #Police #Court
The offence is holding a mobile communication device. Which basically means every police officer that while driving operates their chest mounted radio that requires a positive grip in order to operate the switch to transmit is also an offence which not one of them is held accountable for

I can agree with this. I mean in new cars your playing with a tablet to use different functions of the car. tablet is a phone that doesn't make calls. so whats the different

is this in ireland or UK, as these fellas are irish, as far i understand, in the uk, if you touch any phone craddled or in your hand is an offense, same as touching a tomtom satnav, also newly added touching your smart watch.

the laws are vague for a reason.
driving with undue care and attention is the one they'll hit you with cos its extremely subjective

Definitely not illegal to touch however if you were to crash and it was deemed that interacting with the phone was a contributory factor then that could possibly go against you.

my opinion :
just like it's ok to scroll through your laptop size car display screen just to change your air con. very dangerous and i cannot, for the life of me, understand how or why the manufacturers thought having these in modern cars was a great idea.

Does it not then become “driving without due care and attention” if you touch it in a cradle

I asked a traffic cop this same question. He said, grey area. Holding the phone is a No. Touching it in a cradle is ok as long as they (the police) don’t think it’s impairing your driving. He basically said use your common sense and it’s no different to modern cars with touch screen

PatHoran :
The offence is to "hold a mobile phone". The law defines holding as
"holding the phone by hand or supporting or cradling it with another part of the body. So if it's resting on your shoulder you're technically holding it and committing the offence.

just a stupid offense anyway.....I see every cyclist in London riding hands free while texting .....and scooter riders texting with one hand.......they are only attacking drivers when those other people could hurt others too 😳
