To immigrants who got laid off & have 60 days before you have to leave America There are 7 options that may work for SOME of you. 1. Ask for a ‘garden leave.’ Instead of severance, ask your employer to keep you on payroll for another month or two. A few friends of mine have done this. It buys you more time, without technically triggering the 60-day clock yet. This works best at smaller companies where you have a good relationship with your manager or founder. 2. Move to a B-2 visitor visa. This is what most people do. You can apply for a B-2 through change of status, stay legally for 6 months, and even apply for an extension. But be ready to show good reasons, like multiple interviews or job applications in progress. 3. Switch to H-4 if your spouse has an H-1B. If your spouse is on an H-1B and has an approved I-140, you can switch to an H-4 and apply for the H-4 EAD. The EAD lets you work for any employer with zero restrictions. The only catch? If your spouse loses their H-1B, you lose your status too. 4. Go back to school on an F-1 visa. Not ideal, I know. But enrolling in a one-year program at an affordable university buys you time to regroup and job hunt. Some folks also use this as a bridge to apply for a Day 1 CPT. I don’t recommend that, but hey, if you’re going that route, please vet the uni and talk to a lawyer about it. 5. Apply for the J-1 Early Career STEM Research Initiative This one’s super under the radar. The J-1 ECSRI visa was launched in 2021 for early-career STEM researchers. But here’s the kicker—it’s not just for postdocs. If you work in R\&D at a private company, and your job is research-heavy, you might qualify. Some J-1 sponsors are open to this—so don’t ignore it. 6. Apply for IEP Do you wanna be a founder? Can you raise funding fast? You may qualify for IEP, which lets founders stay and build their company in the U.S. for up to 5 years. 7. Apply for an O-1 visa. This is what I’m on now. No lottery. No salary requirement. Can be renewed forever. It’s meant for people at the top of their field—but with 6–12 months of focused Checkout case studies on my profile
