A lawyer for Charlie Kirk's family urged the judge in Tyler Robinson's preliminary hearing today to make all evidence available to the public. "The Kirk family believes strongly that if the evidence is being admitted in this preliminary hearing, it should be made public for the world to see. No redactions," said Jeffrey A. Neiman, a partner with Neiman Mays Floch & Almeida PLLC in Fort Lauderdale, Florida. Neiman's comments came as Judge Tony F. Graf Jr. was considering the admissibility and redactablity of investigators' video recorded interview with Lance Twiggs, Robinson's roommate and romantic partner, which Robinson’s lawyers said prosecutors will portray as a confession. The judge said certain portions "are not publishable in the courtroom or on to be broadcast." Neiman said "to not be transparent here, to not be open, to not let the world see what happened, will create doubt and distrust in the judicial system, and that's not what anybody wants." "That's not what any of us believe should happen here. And we'd ask the court to consider the position of the family making its ultimate decision," Neiman said. Robinson's lawyer Richard Novak said, "We just want to say that we totally respect Ms. Kirk's position in this situation, as well stated by her counsel." "There are some things which the Supreme Court has said the public has to wait for the jury trial in order to hear evidence, because the number one preeminent question is, 'How do we protect Mr. Robinson's right to a fair trial?'" Novak said. "And with all due respect to the Kirk family, and with all due respect to the media, and with all due respect to the public, the number one concern in this proceeding is Mr. Robinson's right to a fair trial, which means a jury which has not been exposed before it's in this courtroom, under this court's supervision with this court's guidance, to pretrial information of this nature," Novak said. Graf said he is "trying to take a narrow approach in recognizing and balancing transparency with constitutional rights, and doing so in such a manner that it is meaningful and doesn't diminish the court's duty as a magistrate under the probable cause determination."
