The Court found that the defendants manufactured, sold, and offered for sale the "E RIDE PRO" series electric off-road motorcycles, including but not limited to the "E RIDE PRO S," "E RIDE PRO SS 2.0," "E RIDE PRO SS 3.0," "E RIDE PRO SR," and "E RIDE PRO MINI" models, which fell within the scope of protection of Surron's design patent titled "Light Electric Off-Road Motorcycle" (Patent No. ZL201730077820.5). Accordingly, the Court ordered the defendants to immediately cease the infringement and jointly compensate Surron for economic losses and reasonable expenses incurred in protecting its legitimate rights and interests, totaling RMB 5,441,829.51. Surron is the lawful rights owner of the design patent involved in this case. The patent remains valid and in full force and effect and was recognized with the Outstanding Design Patent Award at the 20th China Patent Awards. Through this judgment, the Court determined that the overall designs of the "E RIDE PRO" series electric off-road motorcycles fall entirely within the scope of protection of Surron's design patent. The Court further found that the defendants' manufacture, sale, and offering for sale of the infringing products constituted joint infringement.
