@fidan_tok: Caldwell & Caldwell a decision of the Federal Circuit & Family Court of Australia concerning discretionary trusts. #lawyersoftiktok #casenote
I don’t agree! The trusts should have been out. She knew they were created for the sole purpose of keeping them in the family…. That’s just spiteful in my book. I’m interested to know how her kids felt about that one!

She had his children, that allowed him to build the business so she should get some of the trust.

You are so good at explaining these complicated legal aspects in a way that they are so understandable. What an amazing benefit to your clients. Have you thought of being a law professor (or whatever it may be called if it is something else in Australia) at some point? Maybe later in your career?

Even on 16 million thats 8 Million on a 50/50 although he said to give her more because of the trust, without touching the trust. And when she passes away it'll most likely go the kids just like the trust so although I get sticking it to him- it really makes me question what the desired outcome is? A few extra million at the cost of a heap of court and lawyer fees 🤷♀️

Im still over here wondering how there’s a casual $6m of ‘maybe assets’ before the trust debate!

what's the point of setting up trusts and putting clauses if it can all be undone? seems like the law always contradicts itself and you can argue any points. what's the point in having laws if they can then undone

Coco :
The Trust itself should not be a marital asset as the husband's father was the Controller until 2022 - not the husband. If Trusts are to be included arguing husband is the Controller - then it should be confined to increase in value from date the spouse became the Controller.
